The unit trust remains a popular structure for investment funds formed in common law jurisdictions (such as Bermuda, the Cayman Islands and Ireland). Unit trusts are generally established under a trust deed which give the holders of the units (the investors) beneficial interests in the trust property. Unit trusts are often used (in place of companies or partnerships) for investors in jurisdictions where participation in a unit trust is more acceptable or attractive than equity interests in a company or partnership.
A unit trust requires a licensed trust company to act as trustee. Maples Fiduciary is licensed to act as a trustee in Bermuda and the Cayman Islands, and is also able to offer single purpose trust companies, which act as trustee of a single unit trust or group of related unit trusts.
